Product Assessment Terms
Last updated: September 2026
These Product Assessment Terms govern TuBoleto’s commercial and informational product-assessment service designed to help brands and Vendors evaluate the potential viability of a product for the Canadian market.
These terms supplement the International Vendor & Services Terms and any applicable order, quotation or specific agreement.
1. Nature of the Service
Product Assessment is a commercial research and analysis service based on information available at the time of the assessment.
The assessment may consider, where applicable:
- product characteristics;
- pricing;
- competition;
- market saturation;
- potential sales channels;
- general import considerations;
- general labelling or compliance considerations;
- estimated costs;
- logistics considerations; and
- other factors relevant to market entry.
2. Price
The current Product Assessment price is CAD $299 per product, unless TuBoleto provides a different written quotation.
3. Non-Refundable Fee
The Product Assessment fee is non-refundable once assessment work has begun.
The fee is not automatically credited or deducted from future TuBoleto services.
Any exception must be expressly agreed by TuBoleto in writing.
4. One Product per Assessment
Unless otherwise agreed, each assessment covers one principal product or SKU.
Variants, formulations, sizes, presentations or additional products may require separate assessments where they create material differences in market, pricing, regulation, importation or logistics.
5. Information Supplied by Vendor
Vendor must provide complete and accurate information about the product, including where applicable:
- name and description;
- brand;
- manufacturer;
- country of origin;
- ingredients or materials;
- weight and dimensions;
- target price;
- photographs;
- existing labels;
- certifications;
- regulatory documentation; and
- other information reasonably requested.
6. Reliance on Vendor Information
TuBoleto may base part of its analysis on information supplied by Vendor.
TuBoleto will not be responsible for conclusions materially affected by inaccurate, incomplete, outdated or misleading information supplied by Vendor.
7. External Sources
The assessment may use information from public sources, marketplaces, retailers, databases, websites, research tools, external providers and other third-party sources.
Such information may change, be incomplete or contain errors.
8. Assessment Date
The assessment reflects information and conditions available approximately at the time the assessment is performed.
Market conditions, prices, competition, regulations, tariffs, logistics costs, marketplace policies and other factors may change afterward.
9. No Sales Guarantee
A positive assessment does not guarantee sales, demand, profitability, order volume, consumer acceptance or commercial success.
10. No Profitability Guarantee
Any margin, pricing, cost or profitability estimate is indicative only and depends on variables that may change, including product cost, transportation, duties, taxes, storage, fulfillment, returns, advertising, commissions and market prices.
11. No Regulatory Certification
Product Assessment does not constitute regulatory certification or approval by a Canadian authority.
Where a product requires specialized regulatory review, permits, licences, testing or certification, additional professional or governmental review may be required.
12. No Legal Advice
The assessment does not constitute legal advice.
TuBoleto may identify general considerations, but Vendor should obtain professional legal advice where appropriate.
13. No Binding Customs Ruling
The assessment does not constitute a binding CBSA ruling, final tariff classification or guarantee of customs admissibility.
14. No Marketplace Guarantee
The assessment does not guarantee that Amazon, Walmart, eBay, Best Buy or another marketplace or retailer will approve the product, listing, category or Vendor account.
15. Competition Analysis
TuBoleto may review comparable products, pricing, brands, listings and other indicators to estimate competitive conditions.
Low competition does not guarantee commercial opportunity, and high competition does not necessarily mean that a product cannot succeed.
16. Pricing Analysis
TuBoleto may compare Vendor’s target price with observed market pricing.
Vendor retains final responsibility for setting its selling price.
17. Regulatory Considerations
TuBoleto may identify general regulatory requirements that appear relevant to the product based on available information.
The assessment does not replace a complete review by a lawyer, customs broker, regulatory consultant, laboratory, government authority or other qualified professional where such review is required.
18. Import Considerations
TuBoleto may identify general considerations relating to origin, classification, documentation, duties, taxes, permits or import restrictions.
The results are informational and may require additional validation before the first commercial shipment.
19. Estimated Costs
Where the assessment includes estimates for transportation, importation, storage, fulfillment, marketplace or other costs, those figures are approximate and may change.
An estimate does not constitute a contractual rate unless TuBoleto later incorporates it into a quotation or service order.
20. Currency Conversion
Where currencies other than Canadian dollars are used, any currency conversion is approximate unless expressly stated otherwise.
Later exchange-rate fluctuations may affect costs, pricing and margins.
21. Assessment Conclusion
TuBoleto may provide a conclusion or recommendation based on the factors reviewed.
That conclusion is a commercial informational opinion and does not constitute a guarantee of outcome.
22. Conditional Recommendations
TuBoleto may recommend proceeding, modifying, reviewing again or not proceeding with a product.
A recommendation may be conditional on factors such as price, labelling, documentation, costs, compliance, packaging, volume or sales channel.
23. Vendor’s Final Decision
Vendor retains the final decision on whether to import, sell, modify, withdraw or continue developing the product.
TuBoleto does not assume responsibility for commercial decisions made solely on the basis of an assessment without considering later changes or additional professional advice where appropriate.
24. Delivery Time
The estimated time to complete an assessment depends on product complexity, information availability and the need for additional research.
Communicated timelines are estimates unless a specific written commitment applies.
25. Requests for Additional Information
TuBoleto may pause or delay an assessment where material information required to complete the analysis is missing.
Vendor must respond reasonably to such requests.
26. Product Changes
If Vendor materially changes formulation, ingredients, manufacturer, country of origin, packaging, size, target price, intended use or other material product characteristics after the assessment, a new review may be required.
27. Corrections
If Vendor identifies a clear factual error in the assessment, Vendor may request a reasonable review.
TuBoleto may correct confirmed errors without converting the assessment into a guarantee of outcome.
28. Later Updates
An assessment does not include indefinite updates after delivery.
A new assessment or update may be subject to a new fee where the product, market, regulation, costs or commercial conditions have materially changed.
29. Internal and Commercial Use
Vendor may use the assessment for internal planning and commercial decision-making.
Vendor must not present the assessment as an official certification by TuBoleto, the Government of Canada, CBSA, Health Canada, CFIA, Amazon, Walmart or another entity.
30. Confidential Information
TuBoleto will reasonably treat non-public commercial information supplied specifically for the assessment as confidential, subject to operational requirements, authorized providers and applicable legal obligations.
31. Vendor Intellectual Property
Vendor retains its rights in trademarks, photographs, designs, recipes, formulations, documents and other proprietary materials supplied to TuBoleto.
Vendor authorizes TuBoleto to use such materials to the extent reasonably necessary to perform the assessment.
32. TuBoleto Methodology and Tools
TuBoleto retains rights in its methodologies, templates, formats, processes, software, models, automations, prompts, analytical tools and know-how used to produce the assessment.
33. Automated and AI-Assisted Tools
TuBoleto may use automated or AI-assisted tools as part of research, classification, comparison, analysis or report preparation.
Where appropriate, outputs may be subject to human review before delivery.
Use of such tools does not eliminate limitations associated with external data, changing information or analytical assumptions.
34. Third-Party Information
TuBoleto does not control and does not guarantee the continuing accuracy of information obtained from marketplaces, retailers, databases, external providers, websites or third-party tools.
35. Vendor Cancellation
If Vendor cancels the request after assessment work has begun, the assessment fee remains non-refundable.
36. Inability to Complete the Assessment
Where TuBoleto determines that it cannot reasonably complete an assessment because of insufficient information, product restrictions or extraordinary circumstances, TuBoleto may communicate available options to Vendor.
Any exceptional treatment of the fee must be expressly approved by TuBoleto.
37. Later Services
Purchasing a Product Assessment does not require Vendor to purchase warehousing, fulfillment, import, marketplace or other TuBoleto services.
Likewise, purchasing later services does not automatically change the non-refundable and non-creditable nature of the Product Assessment fee.
38. Relationship with Other Terms
These terms must be read together with the International Vendor & Services Terms and any applicable service order or specific agreement.
Where there is a conflict, a specifically negotiated written agreement may prevail with respect to the particular matter it addresses.
Important: Product Assessment is a decision-support tool. It does not guarantee sales, profitability, importability, regulatory compliance or acceptance by marketplaces or authorities.
