Import & Product Compliance Responsibilities
Last updated: September 2026
These terms establish responsibilities relating to importation, customs, documentation, tariff classification, permits and product compliance for Vendors using TuBoleto services.
These terms supplement the International Vendor & Services Terms and any applicable service order, quotation or specific agreement.
1. Importer of Record
The international Vendor remains the Importer of Record (IOR) for its products.
TuBoleto does not act as Importer of Record, owner for customs purposes, purchaser, responsible consignee, customs broker or another responsible importing party. Vendor must not identify TuBoleto in any of those capacities.
Vendor’s importer account, documentation and clearance workflow must be prepared before the international shipment is dispatched.
2. Vendor Importer Responsibilities
Vendor is responsible for its importer account and applicable registrations, its products, the accuracy of information and declarations, duties, GST/HST, import taxes and other import and compliance obligations.
TuBoleto may provide administrative importer-setup assistance and coordinate with licensed professionals, but that assistance does not transfer or reduce Vendor’s legal obligations.
3. Customs Brokers and Other Providers
TuBoleto may coordinate with customs brokers, freight forwarders, carriers and other logistics providers.
Using a customs broker does not automatically transfer the importer’s legal responsibilities to the broker or to TuBoleto.
Where Vendor authorizes TuBoleto to coordinate with a third party, TuBoleto may transmit information reasonably necessary to perform the service.
4. Product Information
Vendor must provide complete, accurate and timely product information, including where applicable:
- commercial name;
- detailed description;
- intended use;
- materials or composition;
- ingredients;
- manufacturer;
- country of origin;
- commercial value;
- weight;
- quantity;
- brand;
- model;
- SKU;
- UPC or EAN; and
- other information reasonably required.
5. Import Documentation
Vendor is responsible for supplying required import documentation, which may include:
- commercial invoice;
- packing list;
- certificate of origin;
- licences;
- permits;
- regulatory certificates;
- manufacturer information;
- composition or ingredient information;
- health or phytosanitary certificates where applicable; and
- other documents required by authorities.
6. Tariff Classification
Vendor must provide sufficient information to support a reasonable tariff-classification process.
Where TuBoleto, a customs broker or another third party assists with HS classification, that assistance may rely on information supplied by Vendor.
TuBoleto does not guarantee that a proposed classification will be accepted by CBSA or another authority.
7. Customs Valuation
Vendor is responsible for providing complete and accurate commercial values.
TuBoleto will not intentionally alter values, descriptions, origin or other information for the purpose of unlawfully reducing duties or taxes.
8. Country of Origin
Vendor must provide accurate origin information and supporting documentation where required.
The location from which a product is shipped does not necessarily determine its country of origin for customs purposes.
9. Duties, GST/HST and Import Taxes
Vendor is responsible for duties, GST/HST, import taxes and other government charges associated with its products, except where applicable law provides otherwise.
Vendor will be responsible for additional charges resulting from inaccurate, incomplete or misleading information supplied by Vendor.
10. Customs Inspections and Examinations
CBSA or other authorities may select goods for inspection, examination, document review, sampling or other controls.
TuBoleto does not control those processes and does not guarantee release times.
Inspection, storage, demurrage, additional handling or similar costs may be Vendor’s responsibility depending on the shipment structure and applicable agreement.
11. Border Delays
TuBoleto will not be responsible for delays caused by:
- CBSA;
- other authorities;
- incomplete documentation;
- pending permits;
- inspections;
- regulatory testing;
- border closures;
- port congestion;
- carrier delays;
- force majeure; or
- other circumstances outside TuBoleto’s reasonable control.
12. Product Compliance
Unless TuBoleto has expressly accepted a specific compliance task in writing, Vendor is responsible for ensuring that its products may be lawfully imported, distributed and sold in Canada.
Vendor must identify and comply with regulatory requirements applicable to its product category.
13. Labelling
Vendor is responsible for the accuracy of product information used for labelling.
Depending on the product, requirements may include:
- English and French;
- product identity;
- net quantity;
- ingredients;
- nutrition information;
- allergens;
- warnings;
- country of origin;
- importer or dealer information;
- lot information;
- expiry or best-before information; and
- other mandatory statements.
14. Labelling Work Performed by TuBoleto
Where TuBoleto performs labelling, relabelling or sticker application, it will do so using information, artwork or instructions approved by Vendor.
Vendor remains responsible for the accuracy of regulatory and commercial content supplied, except for execution errors directly attributable to TuBoleto.
15. Restricted or Regulated Products
Vendor must not send products subject to special requirements without informing TuBoleto in advance and obtaining applicable acceptance where required.
Depending on the category, this may include:
- food products;
- cosmetics;
- health products;
- children’s products;
- electrical products;
- chemical products;
- dangerous goods;
- products requiring licences;
- products subject to import restrictions; and
- other regulated categories.
16. Prohibited Products
TuBoleto may reject products that are illegal, counterfeit, unsafe, recalled, prohibited, improperly documented or incompatible with its facilities or services.
17. Regulatory Changes
Laws, regulatory requirements, import policies and marketplace requirements may change.
Vendor is responsible for informing TuBoleto when Vendor becomes aware of a change that materially affects the legality, safety or commercialization of its products.
18. Recalls and Safety Alerts
Vendor must immediately inform TuBoleto of any recall, safety alert, regulatory investigation, stop-sale order, material defect or contamination that may affect inventory stored or distributed by TuBoleto.
TuBoleto may suspend fulfillment, quarantine inventory, stop sales, preserve evidence and cooperate with the appropriate authorities.
19. Recall Costs
Unless the event was caused solely by TuBoleto’s fault, Vendor will be responsible for reasonable costs associated with identification, segregation, inspection, return, destruction, disposition or handling of products affected by a recall.
20. Records and Traceability
TuBoleto may maintain reasonable records relating to receiving, inventory, lots, orders, returns, movements and other activities required to provide services or meet legal obligations.
Vendor must maintain its own records where required by applicable law.
21. Government and Regulatory Requests
Where TuBoleto receives a valid request, order or requirement from a competent authority, TuBoleto may provide information, restrict inventory, stop movements or take other measures reasonably necessary to comply with law.
22. Regulatory Holds
Inventory subject to investigation, recall, inspection, government order, incomplete documentation or safety concern may be held or quarantined until TuBoleto reasonably determines that it may be released.
23. Incorrect Vendor Information
Vendor will be responsible for costs, delays, adjustments, fines, penalties or losses directly resulting from materially inaccurate, incomplete or misleading information supplied by Vendor.
24. TuBoleto Assistance
TuBoleto may assist Vendor in identifying requirements, preparing documentation, coordinating services, requesting information and organizing external providers.
This assistance does not replace professional legal, customs, tax or regulatory advice where such advice is required.
25. External Professionals
TuBoleto may recommend or coordinate with customs brokers, regulatory consultants, laboratories, freight forwarders, carriers or other professionals.
Where those third parties act directly for Vendor, their services may be governed by separate terms and charges.
26. Extraordinary Costs
Vendor may be responsible for additional costs reasonably associated with:
- inspections;
- customs examinations;
- extraordinary storage;
- demurrage;
- detention;
- rework;
- additional documentation;
- testing;
- sampling;
- destruction;
- return to origin; or
- additional professional services.
27. Marketplaces and Retailers
Compliance with Canadian legal requirements does not guarantee that Amazon, Walmart, Best Buy, eBay or another marketplace or retailer will accept the product.
Each channel may impose additional labelling, packaging, dimensional, safety, documentation, traceability or preparation requirements.
28. Vendor Representations
Vendor represents that information supplied to TuBoleto concerning its products, origin, composition, manufacturer, value, documentation, permits and compliance is true and complete to Vendor’s knowledge.
Vendor must update that information when a material change occurs.
29. Limits of TuBoleto’s Role
TuBoleto does not guarantee:
- approval of a product by an authority;
- a final tariff classification;
- customs admissibility;
- the release time of an import shipment;
- approval of a licence or permit;
- acceptance of a product by a marketplace; or
- the absence of future regulatory changes.
30. Suspension for Compliance Risk
TuBoleto may suspend a service where there is a reasonable concern involving legality, safety, documentation, counterfeit goods, recall, importation, sanctions, fraud or regulatory compliance.
31. Cooperation
Vendor must respond reasonably to information requests necessary to investigate import, compliance, safety or traceability issues.
32. Relationship with Other Terms
These terms must be read together with the International Vendor & Services Terms, Warehouse & Inventory Terms, applicable service order and any other applicable agreement.
Where there is a conflict, a specifically negotiated written agreement may prevail with respect to the particular matter it addresses.
Important: TuBoleto provides assessment, administrative guidance, logistics coordination and operational support. TuBoleto does not act as Importer of Record, customs broker, lawyer, tax adviser or regulatory authority and does not guarantee registration, customs release, admissibility, duties, taxes, permits or regulatory approval.
